摘要
地理标志作为一笔巨大的历史文化遗产,正逐渐成为我国知识产权的“长项”之一。世界上通行的关于地理标志的立法模式有两种,这就使得在历史和现实因素的双重影响下,WTO各缔约国关于地理标志的谈判在一段时间内很难取得突破性进展。
Geographical Indications, as a huge historical heritage, is becoming the strongpoint of the intellectual property of our country. Analyzing the two-tired system in the TRIPS agreement and the different legal forms in France and America, this article comes up with the point that because of different historical and economic concerns, the WTO members can not make an agreement on this issue within a short period.
