我国《刑法》第五十五条的立法缺陷及完善

Legislative Fault and Perfecting of Article 55 of Criminal Law

我国《刑法》第五十五条第二款规定,“判处管制附加剥夺政治权利的,剥夺政治权利的期限与管制的期限相等,同时执行”。但当对犯罪人存在先行羁押的情形时,如果规定两种刑罚“期限相等”,则两种刑罚不可能实现“同时执行”。

According to Article 55, Section 2 of the Criminal Law,someone is sentenced public surveillance and deprived of polilical rights, the two punishments＇ deadline are equal and are enforced at the same time.When the prisoner is enforcd in jail ahead, if the two punishments have equal deadline,the two punishments will not be enforced at the same time.
