摘要
我国正处在人权观念不断进步的时代,这既是一个刑法规则膨胀(严密法网)的时代,又最有可能是一个社会和谐不断受到威胁的时代。在这个时代,刑法理念应当适时更新。具体为:刑法应以实施宪政为价值取向;以坚持相对罪行法定为原则;以保障人权、保护社会而给予必要之惩罚为必要;提倡刑法谦抑,体现人文关怀。
The human rights concept is in the continuous advancement now in China. On the one hand criminal regulation keeps expanding, but on the other hand it is the most possible that our social harmony be threatened. Therefore at this age the notion of criminal law should be updated accordingly. That is, criminal law should be constitutionalism-oriented, no crime, then no punishment as the principle, the necessary punishment is needed in order to guarantee human rights and protect our society, and restrained criminal law is advocated to show humane consideration.
