试析我国中医药知识产权保护问题与对策

Protection of Intellectual Property of Traditional Chinese Medicine in China:Problems and Countermeasures

随着“天然药物”的兴起,我国中医药知识产权正以惊人的速度流失。针对国内中医药知识产权保护存在的问题,笔者以为,强化知识产权保护意识,构建复合式中医药知识产权保护体系,另辟蹊径保护中医药传统知识,促进中医药的现代化,利用、参与中医药知识产权保护的国际立法,是可行的保护途径和对策。

With popularity of ＂Natural Medicine＂, intellectual property of traditional Chinese medicine is running off at an overwhelming speed in China.Facing this situation ,the author presents some problems and fea- sible countermeasures on protection of intellectual property of traditional Chinese medicine ：to strengthen the consciousness,to build up a complex system of the methods,to employ new approaches,to accelerate the mod- ernization of traditional Chinese medicine, to participate in legislature of international law concerned and take advantage of them.
