摘要
集体谈判制度是现代西方市场经济国家已实行了近百年的用以规范和调整劳动关系的一种十分有效的手段和方法,其目的是化解劳资矛盾,使劳资双方达成共识,签订集体合同。我国推行这一制度也已有十年的历程,但是目前这种制度还存在诸多问题。本文通过对集体谈判制度在中国产生的历程以及实施现状的考察,探讨其在中国产生和发展的特殊性,以期求得对集体谈判制度在中国的运用和推广更为深入的认识。
The collective bargaining system is a basic means to regulate labor relations, which has been adopted by western countries of capitalistic market economy for over one hundred years. Its aim is to reconcile the conflicts of the parties of labor relations and to cause them to formulate collective agreements. Although it has been adopted by China for about ten years, a great deal of problems still exists. These problems and the particularities of collective bargaining system of its development in China will be found out in this thesis in order to perfect the system of collective bargaining in our country, with the help of quoting western advanced experience for reference.
