驰名商标反淡化的立法缺失

Absence of Legislation regarding Trademark Anti-dilution

发达国家驰名商标反淡化立法和司法已基本成熟。我国商标法以及相关法律法规中虽然有所涉及,但驰名商标反淡化的立法在驰名商标淡化行为的性质、法律后果的承担、驰名商标淡化行为的表现形式等方面还存在立法缺失,致使企业驰名商标的自我保护和司法保护缺乏法律依据,实践中造成混乱和困难。因此,完善驰名商标反淡化立法十分必要。

While the trademark anti-dilution legislation and judication in the western countries are rather developed, the trademark anti-dilution in China, though covered in a certain way by the Trademark Law of the country and other relevant regulations, is characterized in legislation by the absence of the provisions regarding the nature and form of as well as legal responsibility for trademark dilution behaviors. Consequently, the trademark self-protection of the enterprise and the legal protection of trademark have no provisions as the basis, bringing about difficulties and confusion in practice. Therefore, it is of vital importance to perfect the trademark anti-dilution legislation in China.
