摘要
NAFTA第11章被喻为“投资者的权利宣言”,而投资争端仲裁机制则是投资者权利得以实现的有效保障。然而,该机制运作至今,对其欠缺透明度和民主参与性的指责就从未平息过。众多非政府组织、代表不同领域公共利益的民间团体,不断提出以法庭之友身份参与投资争端仲裁程序的要求,并积极向N A FTA投资仲裁庭提交书面意见,希望通过这种途径监督国家不能以牺牲公共利益为代价换取对外国投资者利益的保护。
Chapter 11 of NAFTA accords investors involved in disputes with treaty-member states a privatized, sped-up means of dispute resolution that has the effect of hiding the resolution process from public view. However, the criticism concerned on the transparency and democratic participation have never ended. Non-disputants such as non-government organizations urge NAFTA tribunals to accept amicus curiae briefs, so that the public purpose would be better served and the public trust in private dispute resolution that affects policy-making more likely secured.
