On the Legalization of Citizens' PE Rights

体育权利是公民享有体育运动的权利,由利益、资格、权能和自由四大要素构成,并与生命健康权相互关联。体育权利作为人类追求生命健康的一项独立权利,应该法律化,使其纳入法制保障体系而成为公民权利的重要内容,国际社会、西方主要国家和我国对公民体育权利均进行了立法保护;建立体育纠纷化解机制,是体育权利法律救济的有效途径,但我国在解决体育纠纷的方式上还需进一步健全和完善。

PE right meags.that the citizens are entitled to have the rights of PE sports, which consists of profit, qualification, right and freedom. They are related to the rights of life and health. PE right, as an independent right of human beings＇ pursuing life and health, should be legalized, becoming the guarantee system and an important part of civil rights. International society, the leading countries in the West and our country legislate to protect citizens＇ PE rights, establishing the mechanism to arbitrate PE dispute, which is effective in giving legal help to PE rights, but it should be further improved in the way of settling PE disputes.
