摘要
本文依据对行政自由裁量权的界定,通过分析教师惩戒权的性质,明确了教师惩戒自由裁量权的存在,并通过教师滥用自由裁量权的事实,提出了合理控制教师惩戒自由裁量权的几点意见,从而维护学生权益,实现有效管理,依法治校。
According to the definition of administrative free adjudication, this article analyses the nature of the punishment power of teachers and makes clear the free adjudication in the punishment power of teachers. With the facts that teachers abuse it, the authors argue that teachers' free adjudication must be controlled rationally in order that students' rights and interests can be stuck up to achieve effective administration, and manager school by law.
