摘要
QQ号码具有客观上的可管理可支配性,具有经济价值,属刑法意义上的“财物”,可以成为盗窃罪的犯罪对象。盗窃QQ号码转卖牟利的行为构成盗窃罪,同时侵犯他人通信自由,构成侵犯通信自由罪,属想像竞合犯,应从一重罪处罚,定盗窃罪为宜。
The QQ numbers are objectively manageable and governable with economic values, which means they belongs to the ＂propexty＂ in Criminal Law and might become the object in the crime of stealing. Stealing QQ numbers and selling for profit forms the larceny.
