有前科的公民能否成为公务员?——对《中华人民共和国公务员法》第6条的分析和建议

Can Citizens with Criminal Record Turn to be Civil Servants?——Analysis and Suggestions to the Article 6 of the Law to Civil Servants

罪犯在服刑完毕之后享有公民的政治权利,应当能够成为公务员。认为有前科者不能成为公务员的观点不符合人道主义的原则,不利于有前科者真正地回归社会,否定了刑罚的改造功能,侵犯了其宪法上的平等权,而且妨碍了其政治权利的行使。因此,《公务员法》第6条的规定应当予以适当调整。

After a criminal complete his term of imprisonment, he enjoys citizen＇s political rights and should have the right to be a civil servant. The idea that the one with criminal record cannot be a civil servant is not correct, since it violates the humanism principle, has bad influence on them to complete returning hack to society, denies the reconstruction function of criminal penalty, irffringes equal rights in constitution and obstructs the exercising of his political rights. Therefore, the article 6 of the Law to Civil Servants should be revised properly.
