论我国宪法体制下纵向分权的特点

On the Characteristics of the Vertical Decentralization of Power in Our Country's Constitution

在中央与地方的权力行使上,我国宪法体制下的纵向分权具有分工性;在地方政府的产生方式上,我国宪法体制下的纵向分权具有分割性。由于我国纵向分权的模糊性,有必要借助于立法来廓清中央与地方权力的界限。

The vertical decentralization of power in the Constitution is characterized by both division and separation. In the exercise of the powers of the central and local governments, this vertical decentralization of power has the character of division; and in the manner of the election of local governments, it has a separate character. In view of the obscurity of the vertical decentralization of power in our country , it is necessary to draw a clear line of demarcation between the powers of the central and local governments with the aid of the Legiation Law.
