关于高校法律责任的思考

Reflections on the Legal Responsibility of HEIs

最近几年高校学生状告高校侵犯其权利的案件比重加大,研究高校的侵犯学生权利行为及其应承担的法律责任成为了必要。高校主要侵犯学生的教育权、人身权、财产权、知识产权和法律救济权。侵犯学生权利的高校视情况应承担民事法律责任、行政法律责任和刑事法律责任。教育法律法规对高校的法律责任规定存在缺陷,应予以补充、完善。

Currently, it is essential to study HEIs＇ infringement of the students＇ rights and their legal responsibility. This is of great immediate significance in establishing a normal order of teaching and scientific research. The present paper attempts to explore the chief manifestations of infringing on the students＇ rights by HEIs and their legal responsibility in this regard. Meanwhile, it points out some problems existing in the relevant provisions of the Education Law, and suggests improving the laws and regulations of education.
