论驰名商标法律保护的对策

On the Legal Protection Measures of Well-known Trademarks

TR IPS协议以及《保护工业产权巴黎公约》均规定了驰名商标(well-known trademark),并给以特殊法律保护。可以说对驰名商标提供特殊的法律保护已是国际惯例。新修订的《商标法》以及2002年9月15日实施的《商标法实施条例》对驰名商标保护作了规定。2003年国家工商行政管理总局颁布了《驰名商标认定和保护规定》,对驰名商标认定采取了“被动认定,个案保护”的国际通行做法,从而使得我国驰名商标保护体系接近于完善。但是,中国加入WTO之后还应当按照国际标准进一步改革和完善现有驰名商标法律保护制度。

TRIPS and Paris Convention provided special legal protection to well-known trademarks. It is an international practice to legally protect well-known trademarks. The revised Trademark Law and its implementation regulation have provisions on well-known trademarks. The Rules on Determination and Protection of Well-known Trademarks of the State Administration for Industry and Commerce adopted the universal policy of passive determination and individual protection, which has improved our well-known trademarks protection system further. But China should continue to perfect its well-known trademarks protection system after its entry into WTO.
