论“物权法草案”的鲜明中国特色

对物权法草案是照抄照搬外国物权法的观点不是实事求是的。我国物权法草案是一部独具中国特色的法律草案,具体表现在所有权体系的构建、对农村土地权利体系和规则的设计、对国有资产的保护以及对城市居民住宅所有人的建筑物区分所有权及其规则的确定。因此,物权法草案适合于我国的实际情况,应当尽早通过立法程序确定下来,成为我国社会主义市场经济法制体系调整财产归属和利用法律关系的基本法律。
