An Outline of Theory Base of Law and Economics

交易成本理论、谈判理论和产权理论构成了法经济学的三个基本理论。三个理论的预设基础相同并存在内在的逻辑联系:产权理论在制度层面是最基本的理论,是交易成本理论展开的必要前提,谈判理论着眼于自愿基础上的交易效率。

The paper holds that transaction cost theory, negotiation theory and property right theory are three basic theories of law and economics. The foundations of preserving of three theories are the same and have inherent logic connections： The property right theory is the most basic theory on the system aspect, and the prerequisite that the transaction cost theory is hunched, negotiation theory and focus on the trade efficiency on the voluntary foundation.
