“同一种商品”是指与注册商标核定使用的商品相同的商品。相同的商标包括完全相同的商标与基本相同的商标。对“使用”应作广义理解,对行为认定“情节严重”时应注意本罪的定罪起点。
＇The identical article＇ refers to the same commodity as the one with registered brand. The identical brand includes the same and similar brands. The ＇ application＇ should be comprehended in a broad sense. Attention must be paid to the starting point of conviction in defining conducts of serious details.
