摘要
自由迁徙权是公民的基本权利。宪法权利的缺位是造成中国城乡分割二元社会的根源。因此,在宪法上确立“自由迁徙权”是现代国家制度和社会经济发展的必然要求,并且是当前解决农村流动人口市民待遇的关键。
Free migrating right is the citizen＇s fundamental right. The omission of the constitution right is the origin of separating urban areas from rural areas in China. Establishing free migrating right in the constitution is the inevitable requirement for modern state system and social economic development, it is also the key to solving the problem of entrusting to the rural migrant population rights equal to urban residents.
