RULE BY LAW,DEMOCRACY AND MODERNIZATION

改革开放以来,中国建立了一个渐次完备的法律体系,在立法上取得了举世瞩目的巨大成绩。但在执法、司法实践中,中国法制建设还面临着巨大的难题。有法不依、执法不严、吏治腐败等现象较普遍的存在着。在此情况下,部分人对中国的现代化法治进程失去了信心,甚至认为中国不可能从传统社会转变为现代社会。对此观点,笔者并不认同,在本文中,作者通过对一些基本概念的分析,来论证在中国具有建立法治社会的可能性,同时提出一些在法治建设中需要注意的具体问题,目的是希望重建人们对在中国建立法治社会的信心。

China has established a relatively perfect legal system in the legal practice of more than 20 years, obtaining the whole world＇s focus on lawmaking. But China still faces the huge difficult position in enforcing the law and judicial practice. These phenomena such as not following the law correctly, not enforcing the law strictly, the corruption of officials still exist. Therefore, parts of people have lost confidence in the legal system construction in China, even thinking that it is impossible to build a modem society on the basis of the traditional society. In this article the author does not agree these standpoints, putting forward the possibility of building a legal society by analyzing some basic concepts, pointing out some concrete problems during the construction of a legal society, and the author hopes to rebuild confidence in constructing a legal society in China.
