摘要
现代劳动法的基本理念是保护与救济劳动者,劳动者的预告辞职权是立法对此种理念的体现和维护。但该权利的不恰当行使会损害用人单位的权益,因此必须改革劳动合同解除的具体制度并完善用人单位损失的救济体系以达到双方主体的利益平衡。
Protecting and relieving employees is the basic concept of modern labor law,so the premonitory demission right of the employees is the embodying and defending of this concept in legislation. But the incorrect using of this right will damage the benefits of the employers, so we must reform the specific system of contract cancellation and perfect the remedy system of employers loss to reach the benefit balance of two parties.
