关于劳动教养制度的法律思考

On legal consideration of reeducation through labor system

分析了目前劳动教养制度存在的法律缺陷,主要是劳动教养制度与我国其他法律制度及我国加入的国际人权公约存在冲突、劳动教养的适用条件不明确和劳动教养的审批程序违背程序正义等,进而提出:一是将劳动教养制度纳入司法体系,二是进一步明确劳动教养的对象,三是建立多样性的劳动教养执行方式。

The author analyze the defect of the reeducation through labor system,namely,the reeducation through system are conflict with the others law or regulations in our country and the international human right treaty etc.reform the reeducation through labor system,we should put the reeducation through labor system on the judicial system.determine the object of the reeducation through law system and so on.
