摘要
我国婚姻法中没有对配偶权中的夫妻的相互忠实义务和同居义务及所涉相关法律责任问题作出规定,仅分别对夫妻忠实义务和同居义务作了倡导性和禁止性的规定。文章从比较分析国内外立法经验和现实问题的角度,在深入剖析我国立法方面存在的不足的基础上,就我国婚姻家庭法如何完善对配偶权的法律保护问题提出了具体的立法建议。
Marriage Law of our country has no provision about the duties of fidelity and cohabitation between spouses as well as concerned legal liability. It only makes advocating regulations on duty of fidelity and prohibitive regulations on duty of conhabitation. This article, by comparing and analyzing domestic and foreign legislative experiences and real problems, based on a thorough analysis of deficiency in legislation of our country, gives some concrete suggestions on how to perfect legal protection of consortium in Marriage and Family law.
