证据之王情结的思考

人们将某一时期,具有突出证明作用的证据称为证据之王。从口供到DNA指纹术,其后隐藏着对神和科学的权威崇拜情结。盲目的迷信只能增加对证据之王的依赖性,科技时代不仅需要先进的技术,更重要的是思考如何构建科学证据使用标准和规则,如何确立庭审阶段对这些证据质证、认证规则,构建辅助控辩双方、法官准确认定事实的专门证人制度,以正当程序来确保审判的公正与准确。
