对《刑法修正案(五)》中关于信用卡犯罪的理解

The Comprehension about the Credit Card Crime in the Criminal Law Amendment (5)

《刑法修正案(五)》主要针对妨害信用卡管理行为和信用卡诈骗行为作出补充规定,进一步细化了利用信用卡实施犯罪的行为方式,使得法律更具可操作性。《刑法修正案(五)》的出台为打击目前严重的信用卡犯罪提供了有力的法律依据,但立法解释也并非尽善尽美,并没有解决法律上存在的所有问题,应进一步完善。

The criminal law amendment （5） that the tenth Standing Committee of the National People＇ s Congress 14th session passed made the additional regulation according the behavior of destroying the credit card management and credit card fraud. It further regulated the behavior method of credit card criminal and made the criminal law more maneuverable. The Promulgation of the criminal law amendment（5） offers powerful gist for attacking the serious credit card crime presently. But the legislative interpretation is not so perfectly to resolve all the problems of legislation. To resolve the new questions and new condition arising constantly with judicial act, we must make further consummation of the legislation of credit care crime.
