《物权法》应吸收近十年来改革的新成果

“The Real Laws”Should Assimilate the Reform Achievements over the Last Decade

摘要 本文是中国土地学会和中国土地勘测规划院联合召开的“物权法有关土地问题座谈会”综述,认为《物权法》中集体建设用地等的有关规定应与国务院28号文一致,农村宅基地和国有土地出让的有关规定应考虑实际情况,应充分考虑国有企业在市场经济中的独立法人地位;《物权法(草案)》中对土地权利的界定很不清晰,现实中正在产生或将要产生的许多土地权利内容未写进《草案》,这将影响到土地权利人利益的保护,影响到土地资源的合理利用与保护;目前出台《物权法》的条件尚不成熟,建议先出台物权法大纲,用于指导物权法的制定。 The paper is a summary of “the Symposium on Land Issues Involved in the Real Laws”held by China Society of Land and China Land Surveying and Planning Institute. The paper considers that the relevant stipulation concerning the use of farmland for collective development should be according to the guideline of “28 th Document of the State Council”. The relevant stipulation with regard to the transfer of rural land used for building a house and state-owned land should base on the real situation; the independence legal person position of state-owned enterprises in the market economy should be given full consideration. The paper argues that several disadvantages existed in the “Draft of Real Laws”, which will not only influence the protection for the interests of land right owners but also influence the reasonable utilization and protection of the land resources, these are: delimitation of land rights is not clear and many contents concerning land rights which is either emerging or will be emerging, have not been written in the “Draft”. In view of the above-mentioned facts, the author thinks that the conditions for publishing the “Real Laws”are not ripe. The outline of“Real Laws”should be published first for directing the formulation of “Real Laws”.
