摘要 手机短信以其便捷、高效、低廉的通信方式为广大手机用户进行信息沟通和交流提供了便利条件,但是短信的优良特性却受到滥用行为的侵害,法律不仅仅保护公民对正常信件收阅及保密的权利,而且应当保护对与己无关的垃圾短信拒收的权利。目前,用户无力拒收此类短信,那控制垃圾短信的关键是为垃圾短信发送者提供服务的电信运营商。为此,只有完善立法,建立程序公正的短信监管才能更好地保护公民的通信自由。 The mobile-phone message with its handy, efficient, cheap communication method carried convenience for a large number of mobile-phone customer information linking and exchanging, but the good characteristic of message is suffering violation of abuse behavior. The law not only protects the citizens'rlght that they receive and read normal letters and keep secret, but also should protect the right that they refuse irrelevant garbage messages. Currently, the customer has no way to refuse this kind message. Then the controlling key of the garbage message is the telecommunication company, which provides service for the garbage message dispatcher. So, only perfecting legislation and fair procedures taken charge on the message can protect the citizens correspondence freedom better.
