A Legal Reflection on the Problem of Infringing Commercial Secret in the Flow of Trained Personnel

从商业秘密的概念和特征入手,分析了目前我国人才流动中出现的商业秘密侵权行为给权利人和社会经济发展带来的危害,并从加强立法、完善法规、加大惩罚力度、建立企业内部商业秘密保护制度、对单位职工进行保护商业秘密的法制教育等方面,对人才流动中有关商业秘密的法律保护问题进行了探讨。

This article starts with the concept and Feature of commercial secret. It analyses the action of infringing commercial secret in the flow of trained personnel at present, which will harm people who have authority and socioeconomic development. Legal protection problems are researched, such as strengthening legislation, improving statutes, increasing punishment, building a commercial secret protection systerm in inner enterprise, and giving the staff a legal education on protecting the commercial secret, etc.
