浅谈驰名商标的特殊保护

驰名商标本身就体现着商业价值,具有的超常创汇能力。但是,驰名商标也更加容易招致假冒、不正当竞争等行为的侵害。因此,有必要建立驰名商标的特殊保护制度。本文从中国驰名商标保护的立法现状出发,探讨了驰名商标特殊保护的途径,旨在提出驰名商标特殊保护制度的设计。

Well-known trademark is more likely the target of passing off and unfair competition due to the commercial value and super profit-making ability it possesses. Therefore, it is necessary to establish the system for protection of well-known trademark. Based on the status quo of legal system concerning protection of well-known trademark in China, this article discusses ways to provide special protection for well-known trademarks, aiming at helping the establishment of special protection system of well-known trademarks.
