非洲法律文化研究初探

非洲法律文化属于非洲学和法史学研究的交叉学科。相关研究状况表明,我国的非洲法研究虽然十余年来取得了长足的进展,但总体而言还比较薄弱,学界对非洲法律文化的研究尚未真正展开。作者试图在以往研究成果的基础上,对非洲法律文化研究进行全面的总结和思考,通过多学科的交叉研究,力图辨明非洲法律文化研究中的有关歧义和争议,解决非洲法律文化研究中的基本理论问题,构建非洲法律文化的逻辑体系,给非洲法研究一个准确的定位,以为中国法学研究提供新的视野和思路。

Studying on African legal cuhure is a cross subject of African studies and science of legal history. Some related studies showed that studying on African law in China is still relatively weak as a whole,although domestic African law studies have made certain achievements in the past ten years. The studying on African legal culture in academic community has not been really launched yet. The author attempts to give an overall summary on legal culture of Africa on the basis of past research results. Through multi - disciplinary studies, the author tries to distinguish ambiguous meanings and disputes in research of African legal culture.Moreover, the author also wants to solve the basic theoretical questions arising in the study of African legal culture, construct the logic system of African legal culture and give African law study a proper location, so to offer a new perspective and train of thoughts for legal studies in China.
