摘要
新的《普通高等学校学生管理规定》对高校学生的基本权利义务做出了明确阐述,也规定了当其权益受到侵害时的救济途径。本文沿顺该《规定》的框架和体系,探讨了高校学生处分的可诉性问题及司法审查与高校自主管理的制约和平衡。
The new ＂Students＇ regulation of management of university and college＂ has clearly explained the university students＇ basic rights and obligations. It also has stipulated the way of relieving when their rights are encroached. Obeying the frame and the system of the ＂regulation＂, the author has explored the problem about the students punishment,as well as the restriction and the balance between the justice examining and the independent administration of the university.
