关于现行刑法第一百条的思考

Reflections on the 100th Provision in Our Current Criminal Law

我国现行刑法第一百条的规定一般被学界称为“前科报告制度”。学者们对该法条在刑法中的设定有着不同的认识。在学者对前科制度研究成果的基础上，本文主要从民法、行政法及社会效果方面采用实证方法对该法条进行了分析。据此笔者有针对性地提出了对该法条的一些修改建议。

The 100th provision in our current criminal law is usually called ＂criminal record reporting system＂ by academic circles, over which scholars share quite different opinions. Based on the results of former researches on precious conviction, this paper provides an analysis of this provision through demonstrative method by examining from the standpoint of civil law, administrative law and social effects. Then accordingly the paper proposes some revision suggestions on this provision.
