论机会平等与政府行政公正准则的实施

The Opportunity Equality and Implementation of Justice Principle in Government Administration

社会公正是政府行政的价值基础,而机会平等是政府行政公正准则实施的前提。机会平等包括两层含义:其一,是社会赋予的生存和发展所必须的、最低的基本权利的机会平等;其二,是社会赋予的满足人们政治、经济、思想等方面较高级的非基本权利的机会平等。政府行政公正制度的建设必须在恪守机会平等理念的前提下,在分配、用人、社会保障和教育等方面实施与社会发展相一致的行政公正准则,这些准则包括分配领域的按贡献分配和按基本需要分配相结合的准则、用人领域的德才兼备准则、社会保障和教育领域的公正补偿准则等。

The opportunity equality includes two meanings. First, the opportunity equality is a kind of equality concerning the basic rights which is given by the society. Second, the opportunity equality is a kind of equality concerning higher non-basic rights to fulfill people＇s equality in politics, economy and thinking. In order to realize justice in government administration, the government should implement a series of justice principle, which is in accordance with the society development. In the fields of distribution, follow the rule of combining distribution on contribution and need; in the fields of personnel, follow the rule of combining morality and quality; in the fields of social security and education, follow the rule of complement.
