摘要
建筑物区分所有权是现代物业管理的产权基础,物业管理权从实质上来说是建筑物区分所有权人将其所有权权能的一部分让渡给专业性的、超脱于所有权人之上的物业管理人行使的权利。由于现代物业管理的公共性和让渡性,使物业管理权具有了传统物权以外的性质和特征。但无论如何,物业管理权仍属于物权范畴,这一物权是基于建筑物区分所有权而产生并依附于、从属于所有权。所以,应该以建筑物区分所有权为轴心构建我国物业管理的法律架构。
Approaching from the real estate right foundation of modern real estate management,this essay will analyze the characteristics and the modernization of real estate management,which is a new mode of real estate right based on the ownership of building distinction.The new mode has certain similarity as well as much peculiarity compared with the traditional real estate right.Thus the status of real estate management right should be established in our system of real estate right.
