论ICC“见索即付保函统一规则”下的国际工程保函

International Construction Guarantees and ICC "Uniform Rules for Demand Guarantees"

为降低违约风险,国际工程项目的实施常以各类银行保函作为担保手段。本文即着眼于项目管理人员对国际工程担保知识的迫切需要,从实践的角度对国际工程保函的有关问题进行实务性的讨论。本文首先列举出国际工程中常见的几种保函,然后分别对它们的特点予以分析,接着对国际商会“见索即付保函统一规则”进行了论述,并在文章最后提出了按照该统一规则对即付保函进行解释时所需注意的几个问题。

Guarantees usually are given security for the performance of intemational construction to lower the risk of fault. The purpose of this paper is to discuss these issues practically arid satisfy the urge of security knowledge from ergineering staff. It first lists some kinds of guarantees in common international constructions. Then it iutrtroduces their security system and characters. After that, the ICC Uniform Rules for Demand Guarantees is illustrated from the operating standpoint. At the end, it gives some advices to be paid attention to when explicating demand guarantees by the uniform rules.
