摘要
在就业形势日趋严峻的情况下,用人单位利用自身强势地位在就业协议补充约定中以较长工作年限和高额违约金“来套牢”毕业生,致使毕业生在意思表示不真实的情况下,其正当权益遭到侵害。现有法律机制不能有效地解决上述问题。网上择业能为毕业生提供确定的、有效的、更多的就业信息而免除后顾之忧,以便用人单位与毕业生双向选择并使其结合更能够反映和体现双方的意愿,是尊重行为主体自由选择的重要体现、充分发挥市场机制作用的必要条件和解决择业信息效率问题的最佳选择。
With the employment situation becoming more and more rigorous, employers are likely to make use of their vantage position to restrict the graduates through making graduates sign the complementary agreement of employment with a longer work term and lower penalty fee. It has seriously violated the graduates' rights. However, the present legislation can't solve this issue. The internet job-hunting appears to be a solution to this issue for it can provides graduates more job information but with fewer worries. Through internet, the employers and graduates choose each other and make the employment contracts reflect more intentions of both parties.
