破产债权的确认与确认诉讼——兼论债权确认诉讼中的当事人适格

破产债权的确认作为连结破产程序开始和分配的中间环节,在破产程序中发挥着重要的作用。破产债权申报以后,尚需对之进行确认,才能参加破产分配。但是,我国现行《企业破产法》无论是在债权确认方式上还是在债权确认程序上均存在着较大的缺陷,从而给实务操作带来不少困难。应当在破产债权的申报与调查之后,建立一个完整的债权确认程序,并借助确认诉讼的方式解决债权确认中的纠纷,以保证破产程序的顺利进行。

As an intermediate link between starting and distributing procedure, the system of confirmation for insolvent credit plays a very important role in the whole operation of bankruptcy law. But there are bigger blemish in the present enterprise Insolvent Act in China, whether is in the way of confirmation for insolvent or in the procedure of confn＇mation for insolvent, which handicaps the fulfillment of this law. After proof of debt, the writer claim to establish a complete confirm procedure, combining way that asks for helping confirmation litigation to solute confirm of dispute , which can guarantee bankrupt procedure in smooth progcess.
