On the Trust and Fiduciary Relationship

信托是一种信任关系,而信任关系是信托得以成立并延续的基础。信任关系的实质是受托人的信赖义务,具体表现为忠实义务、善良管理人的注意义务、亲自处理信托事务的义务以及分别管理的义务。受托人违反信赖义务将导致委托人信赖利益的损失,因而应当承担赔偿责任。

Trust is a kind of fiduciary relationship, which is the basis of the emergence and continue of the trust. The essence of fiduciary relationship is the trustees＇ fiduciary duties, including duty of loyalty, duty of dealing with trust matter with utmost diligence, duty to act personally and duty to manage separately. Trustee＇ s any breach of the fiduciary duties will result in the loss of settler＇s fiduciary interests, so he must take the compensatory duty.
