《土地法》中的一个矛盾——论《土地法》对农民土地权益保护的缺失

A Contradiction in the Land Law——On the absence of the protection to peasant's lands profit by the Land Law

《土地法》中有一个矛盾,即一方面规定了农民集体土地所有权,另一方面,又取消了它,这导致农民集体土地所有权处于无司法保护的状态,也间接地导致了我国耕地资源的快速减少。这一矛盾是与《土地法》的立法理念相关联的。

There is a contradiction in the Land Law.on one hand, prescribes peasants have the ownership of the rural land, on the other hand, cancel that. As results, the peasants＇ collective land ownership lost judicial protection, and our country＇s land resources decrease rapidly. This contradiction is related to the legislation conception of the Land law.
