制定考试法,以法律手段规范考试行为,是建设法治社会的需要,也是我国教育实现健康和可持续发展的需要。但是,考试法应当怎样定位,如何更大的发挥作用,是值得我们深入思考的。通过就考试法立法当中的几个基本理论问题的阐述,以期能对考试法的出台和进一步的完善发展有所裨益。

The enactment of Examination Act aims at regulating examinations with law. It is not only the need of construction of a law - governed society, but also the need of a healthy education system of sustainable development. However, it is thought - provoking to make clear how to orient the act and how to bring it into full play. This article illustrates several theoretical problems in order to bring benefit to the enactment and perfection of the act.
