论掠夺性定价的界定及法律规制

掠夺性定价是反垄断法的重要规制对象。其适用原则为透明度原则和程序公正原则。借鉴欧美等国家的经验,掠夺性定价的构成要件应包括主体、主观意图、客观行为等几个方面。而其中的核心就是成本与定价的关系。我国应进一步完善立法,明确掠夺性定价的规制标准,设立专门的执法机关,以维护市场竞争机制,保护消费者的利益。

Predatory Pricing is the major subject that Anti - Trust Law applied to. The principles applied to it should be the transparency principle and the justness of process principle. According to the western experiences, the elements of predatory price are subject,subjective intention,objective behavior etc. The core of the dements is the relationship between the cost and price. Our country should improve it through legislation to clarify the standards of the predatory pricing, set up the executive department to protect the market system and the rights of the consumers.
