On the Obligation of Insurance Agent

目前我国保险代理业务中存在大量违规行为,是引发诸多纠纷与诉讼的根源。从法律角度讲,课以保险代理人的法律义务并追究其违反义务的法律责任是保险代理法律完善的重要内容。保险代理人的义务包括依照保险代理契约应当履行的义务、依照诚实信用原则应当履行的义务、依照默示原则应当履行的义务以及禁止性义务。在违反义务的法律后果方面,应通过民事责任、行政责任与刑事责任的相互配合以达到规范保险代理人行为的目的。

The lots of wrongful acts in China＇s insurance agency lead to disputes and litigations. From the law perspective, it is important to perfect the obligation system and liability system of insurance agent. The insurance agent should carry out the obligation in agency contract, the obligation in principle of good faith, the obligation in implied principle and the prohibitive obligation. As for the legal liabilities on failing to fulfill the obligations, the combination of civil liability, executive liability and criminal liability shall be used to restrict the behaviors of insurance agents.
