论物权法制定中的居住权问题——法社会学的视角

本文从物权法定原则、各国立法状况、现实的客观需要几个角度证成我国设立居住权制度的必要性,着重对建立居住权制度的社会条件进行论证,在此基础上对居住权制度作一简要的内容设计。

The dissertation justifies the necessity of setting up the inhabitation right institution in China from the standpoints of principle of legality of right in rem, legislation practice of other countries and the current needs, it emphasizes on the social conditions of inhabitation right institution. Based on the above, the author concisely designs that institution.
