Transformation of constitution and predicament of constitutionalism in the view of China's century of constitutionalism

分析了宪政产生于西方的原因及中国宪法移植的历史教训,进而指出中国在宪法制度创新的同时,应注重西方宪政文化与中国传统文化的融合。中国的宪政发展不在于宪法规范的修改,根本在于中国宪政精神的培育和宪政文化的陶冶;不在于人权原则的入宪,而在于社会生活中人权的切实保障。

On analyzing the reasons of constitutional origin in the western world and the historical lessons of China＇s constitution transformation, the essay stresses the point that China should evaluate the combination of western constitution culture and China＇s traditional culture, while the constitutional innovating is pro- gressing. The improvement of china＇s constitutionalism is essentially the development of constitutional culture but not the amendment of constitution, and the practical guarantee of human rights but not the human right principle incorporated in constitution.
