国际组织宣言和决议的法律意义——对国际环境法“软法”的探讨

Legal Significance of International Organization Declarations and Resolutions

通过对国际环境法产生重要作用的几个国际组织宣言和决议的述评,分析了它们相应的法律意义,指出虽然国际法院规约没有预见国际组织宣言和决议作为新的国际法渊源,但在国际环境法领域中它们反映了国际社会关于环境保护的共同信念。这些“软法”为各国制定和发展本国国内环境法提供了可借鉴的原则和规则,为各国在不能得到条约正式考虑方面的国际合作提供了基础。

After reviewing on several important international organization declarations and resolutions in international environmental law, the author analyzed their legal significance. Although international organization declarations and resolutions were not considered as new legal resources in the International Court Statute, they reflect the common belief of environmental protection in the international society. These＂soft law＇provide pricinples and rules for states enacting and developing domestic environmental law, and made foundations for international co-opration without formal considering via treaties by states.
