On Essential Content and Essential Form of Law

法的本质内容不是单一的,而是自由、权利与权力这三元或三维要素的统一体,它们是法的核心内容、基石范畴;而法的本质内容是有其形式的,即法的内部结构特征,这种形式也属于本质范畴,它包括法的规范性及其普适性;法的义务性;法的权威性;法的程序性与可诉性;等等。它区别于法的一般外在形式,如法的公开性、统一性、法的时空规限性、法的位阶与种类的多样性,等等。

The essential content of law is not simplex but the entia of freedom, right and power. The above three are the core and the footstone of law. However, the essential content of law has its own form which is the inner structural character. This kind of form belongs to the category of essence and it includes the norm nature, the universality, the obli- gation nature, the authority, the procedure nature and litigant ability of lawo It differs from such general exterior forms of law as the publicity, the unison, the space- time limit, the rank and the variety of law, etc.
