摘要
1)国际体育仲裁裁决的承认与执行在初始研究中受到《纽约公约》、《奥林匹克宪章》和国际体育仲裁院《体育仲裁规则》等规定的影响,其间有与国际体育仲裁制度相适应的方面,亦不乏有与其追求的不和谐之处;2)国际商事仲裁实践中各国立法承认与执行纽约公约裁决时所适用的程序规则较难以适用于国际体育仲裁;3)对《国际商事仲裁示范法》精髓的有效运用将有助于国际体育仲裁裁决的承认与执行。
The initial study on recognition and execution of international sports arbitration was restricted by New York pact ,Olympic Charter and sports arbitration regulations of international sports arbitration court. In the practice of international business arbitration,the procedure of recognition and execution on New York pact in each country＇s legislation hardly applied to international sports arbitration. The effective usage on essence of international business arbitration demonstration law was helpful to recognition and execution of international sports arbitration.
