The Constitution Spirit and the Research of Constructing Administrative Ability——Centering on Constructing a Harmonious Society

行政法作为与宪法关系最为紧密的一个部门法,行政机关的依法执政能力直接决定着宪法精神的贯彻落实以及构建社会主义和谐社会目标的实现。从对当今中国宪法精神探讨入手,阐述提高着政能力建设与贯彻宪法精神和构建社会主义和谐社会的关系,进而指出了“以人为本”、“人权至上”是当代宪法和依法行政的最高原则,是构建社会主义和谐社会的要求,宪法应当体现反特权的人权化精神。

Administrative law, as a department law, is most closely related to construction. The executive ability of administrative agencies is a direct determinant in implementing constitution spirit and realizing the goal of constructing a harmonious socialist society. Starting from the China＇ s constitution spirit, the writer of this paper illustrates the relationship between promoting executive ability and implementing constitution spirit, and the construction of a harmonious socialist society. The writer further points out that ＂human centeredness＂ and ＂the superiority of human rights＂ are the supreme criterion and are required by the construction of a harmonious socialist society. Constitution should embody the spirit of anti-privilegism.
