摘要
市场界定是实施反垄断法的基础,相对周全的市场界定是企业并购规制的良好起点。市场界定通常是评估反垄断法所关注的市场势力的首要步聚,包括产品市场界定和地理市场界定。过去,反垄断当局一般是根据产品功能上的替换性,运用交叉弹性、价格相关测试等方法来界定相关市场。当前,SSNIP方法是比较严谨的基于经济学分析之上的界定相关的重要方法。实施SSNIP的方法有自需求弹性法和临界损失法,临界损失法在实践中日益得到广泛应用。
The market definition question is the foundation for carrying out the law of ant-monopoly; the relative complete market-definition is the good start point for enterprise mergers and acquisitions. The market definition generally is the first step for evaluating the market influence noted by the law of ant-monopoly, including product market definition and geographical market definition. In past times, generally the antmonopoly authority delimits the concerned market according to the replacing nature of the product function, the cross elasticity of the product application, the concerned price examination. At present, SSNIP method is a quite strict delimiting way based on economic analysis. In carrying out SSNIP way there are self-needing elastic: method and critical loss method, the latter one is widely applied in practice.
