摘要
预约在实践中颇为常见,因预约引起的纠纷也普遍存在,但我国《合同法》等民事基本法律对此种合同的规范确是空白。如何认定预约及其效力,违反预约应如何承担法律责任,以及预约中定金条款的适用,是本文探讨的重点。
Precontract is rather common in practice, because dispute caused by precontracrt generally exists . However, our country ＂ contract law ＂etc. civil basic law really blank to the norm of contract. How about to assert precontract and how about to bear liabilities when one violate precontract.It is the focal point that this text probes into.
