国务院批准“较大的市”的行为是“较大的市”立法权的依据,因此从性质上说属于立法行为,应以行政法规的形式发布。同时应明确“较大的市”的法定标准,尽快健全批准程序,使国务院的批准行为有章可循,得以规范。
